Terms of service

Effective 28 August 2026. Survex is provided by Libaty GmbH (“we”).

1. The service

Survex lets facilitators run live, anonymous surveys with participants who answer on their own devices. It is currently offered as a free beta: features, limits and pricing may change, and we may introduce paid plans with notice. Where we do, anything you created stays yours and remains exportable.

2. Your account

• You sign in with a link sent to your email address. Keep that inbox secure — whoever controls it controls your account.
• You must be at least 18 and, if you act for an organisation, authorised to accept these terms for it.
• You can delete your account at any time from the dashboard. That permanently removes your sessions and all answers in them.

3. Your content and your participants

• The questions you ask and the answers you collect are your content. You decide what to ask, whom to invite, and how long to keep results.
• For personal data in your sessions you are the controller in the sense of the GDPR; we process it on your behalf as described in our privacy notice. A data processing agreement is available on request.
• Keep it lawful and decent: no collecting data you are not allowed to collect, no harassment, no content that infringes others’ rights, no attempts to de-anonymise participants.

4. Acceptable use

Do not probe, overload, or interfere with the service, bypass rate limits or access controls, or use it to send unsolicited email. We may suspend accounts that do, and we may remove content that breaks these terms.

5. Availability and warranty

We work hard to keep survex up during your workshop, but the beta is provided as is, without warranty of uninterrupted or error-free operation. Have a fallback for a session you cannot afford to lose.

6. Liability

We are liable without limit for intent, gross negligence, and injury to life, body or health. For slight negligence we are liable only for breach of essential contractual duties, limited to the foreseeable, typical damage. Liability under the German Product Liability Act remains unaffected. As long as the service is free, statutory limitations for gratuitous services apply.

7. Changes and termination

We may change these terms with at least 14 days’ notice by email. Either side may end the relationship at any time: you by deleting your account, we by giving notice — or immediately for serious breaches.

8. Governing law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For merchants, the place of jurisdiction is our registered seat.
